   In accordance with Section 551.042 of the Texas Government Code, this agenda has been posted at the Weatherford City Hall, distributed to the appropriate news media, and posted on the City website at http://www.weatherfordtx.gov within the required time frame. As a courtesy, the entire Agenda Packet has also been posted on the City of Weatherford website at www.weatherfordtx.gov/agendas. All meetings of the Weatherford City Council, Municipal Utility Board, and other boards/commissions/committees of the City of Weatherford are open to the public. Public participation and written comments are invited on all open session business items.
   The Mayor/Chair requests that all electronic devices be turned off or set to vibrate. Members of the audience are requested to step outside the Council Chambers to conduct a phone conversation. Weatherford City Hall is wheelchair accessible and special parking is available on the south side of the building. If special accommodations are required please contact the City Secretary at 817-­598-­4202 a minimum of 24 hours in advance.
   The City Council, Municipal Utility Board, and other boards/commissions/committees of the City of Weatherford, as allowed, reserve the right to enter into Executive Session at any time during the course of this meeting to seek legal advice from the City Attorney on any posted agenda item as authorized by Texas Government Code, Chapter 551.071.
   Unless a Work Session Agenda, or otherwise indicated, action may be taken on any of the following agenda items.

Consider a request for preliminary plat approval for Holland-Santa Fe Addition, 3 lots out of a 26.47-acre tract at the southwest corner of the intersection of Santa Fe Drive and Holland Lake Drive, said tract being situated in the Elsberry Miller Survey, Abstract No. 873 and the J.P. Hart Survey, Abstract No. 1970, City of Weatherford, Parker County, Texas. SBD2022-0051.

Suggested Action:

Staff recommends approval of the preliminary plat for Holland-Santa Fe Addition, subject to all requirements of the subdivision ordinance and, specifically the following conditions. 

 

1. Proposed sidewalks are required to be 6’ wide (Reference Weatherford Municipal Code (WMC) §11-4-4(c)).

2. Provide an exhibit showing areas contributing drainage to the proposed subdivision. The information shall include the area, slope, and type of development (Reference Weatherford Municipal Code (WMC) §11-4-4(h)).

3. Show names of all adjacent subdivisions within 125’ on the existing conditions sheet (Reference Weatherford Municipal Code (WMC) §11-4-5(a)). Also, provide dimensions for all adjacent rights-of-way.

4. The Clear Lake Drive right-of-way limits are not clear as they approach the west side of the area to be platted (Reference Weatherford Municipal Code (WMC) §11-4-5(a)).

5. Show the recording information for the existing 20’ sewer easement on the existing conditions sheet (Reference Weatherford Municipal Code (WMC) §11-4-5(b)).

6. Full right-of-way dedication is required along Holland Lake Drive to provide an 80’ width (Reference Weatherford Municipal Code (WMC) §11-6-2(c)).

 
 
 
 
3.c.
Hold a PUBLIC HEARING to consider a request for a conditional use permit regarding Community Center use on a 2.599-acre tract of land located at 602 West Water Street, City of Weatherford, Parker County, Texas. CUP2022-0011.

Suggested Action:

Staff recommends approval subject to the following conditions.

 

  1. All refuse and services areas shall be subject to current screening requirements as outlined in the Landscape and Tree Manual. Dumpsters shall be kept inside approved enclosures with doors shut. Screening to be completed prior to or concurrently with first phase of construction/expansion.
  2. Existing parking lot and loading zones may be utilized for existing use and Phase 1 expansion. All future phases shall be subject to the standards as outlined in Section 12-4-105 of the Title XII Zoning Ordinance.
  3. Phase 2 through Phase 4 shall be subject to the Site Plan Review process. Additional parking spaces and on-site circulation lanes for pick-up and drop-off shall be provided to prevent hazards and traffic congestion within the site and adjoining public streets, subject to approval by the Planning Director and City Engineer. Alternatives to the Planning Director’s determination must be approved by the City Council upon a recommendation by the Planning and Zoning Commission.
  4. Approval and final inspection of the site plan and all applicable commercial remodel/addition permits is required prior to issuance of a Certificate of Occupancy for each phase.
  5. All existing and new signage for the property shall be brought into conformance with current sign regulations as outlined in Section 12-4-101 of the Title XII Zoning Ordinance. Approved sign permit and final site inspection is required prior to issuance of a Certificate of Occupancy.
  6. Temporary signs, banners, and other advertisement shall not be allowed or permitted on the property.
  7. All buildings on the property shall be limited to the existing use and uses by Cornerstone Community Action Agency. Leasing or subleasing of other buildings is not permitted. If the uses are abandoned, all buildings on the property shall be subject to those uses as listed in Section 12-3-203 of the Title XII Zoning Ordinance.
  8. No variance shall be requested or granted for remodeling and operation of the business.
  9. Full compliance must be maintained and if a third violation notice is issued within an 18-month period all operations must cease until compliance is met.
  10. This conditional use permit will be void if construction has not been started within 8 months of Ordinance approval. Additionally, this conditional use permit will be void if construction has not been completed within 24 months.
  11. This conditional use permit will be void if the use is abandoned for more than 180 days after issuance of Certificate of Occupancy.

 

 
 
 
 
3.d.
Hold a PUBLIC HEARING to consider a request for a conditional use permit regarding Wedding Chapel use on a 12.8 acre tract of land located at 109 Otto Drive, said tract being Lot 1 of the Lugi Addition, City of Weatherford, Parker County, Texas. CUP2022-0010.

Suggested Action:

Staff recommends approval subject to the following conditions.

 

1. Hours of operation shall be limited from 9:00 a.m. to 12:00 a.m. 

2. Music shall comply with the city ordinance and shall be turned off by 11:00 p.m. 

3. A maximum of one (1) monument sign, as permitted by section 12-4-101, may be allowed; not temporary or pole signs are permitted on the property.

4. Temporary signs, banners, and/or offsite advertising shall not be allowed or permitted.

5. Vehicles shall not be parked on grass or within public right-of-way. 

6. No variances shall be requested or granted for development and operation of the business. 

7. Full compliance must be maintained and if a third violation notice is issued within a 18-month period all operations must cease until compliance is met. 

8. This conditional use permit will be void if abandoned for more than 180 days after issuance of Certificate of Occupancy.

Hold a PUBLIC HEARING to consider a request for a conditional use permit regarding a fuel canopy expansion for the existing QuikTrip Fueling Station and Truck on a 7.33-acre tract of land located at 2001 South Bowie Drive, City of Weatherford, Parker County, Texas. CUP2022-0012.

Suggested Action:

Staff recommends approval subject to the following conditions.

 

  1. All offsite improvements shall be permitted and constructed prior to or concurrently with the onsite improvements. Offsite improvements shall consist of the proposed median extension, a minimum of 50’, along South Bowie Drive as shown on the concept plan.
  2. No variance shall be requested or granted for remodeling and operation of the business.
  3. Full compliance must be maintained and if a third violation notice is issued within an 18-month period all operations must cease until compliance is met.
  4. This conditional use permit will be void if construction has not been started within 8 months of Ordinance approval. Additionally, this conditional use permit will be void if construction has not been completed within 20 months.
  5. This conditional use permit will be void if the use is abandoned for more than 180 days.

Hold a PUBLIC HEARING to consider a request for a conditional use permit regarding Auto Sales use on a 1.884-acre tract of land located at 1405 Fort Worth Highway, said tract being Lots 1-4, Block 7, Majors Industrial Addition, City of Weatherford, Parker County, Texas. CUP2022-0013.

Suggested Action:

Staff recommends approval subject to the following conditions.

 

  1. All refuse and service areas shall be subject to current screening requirements as outlined in the Landscape and Tree Manual. Dumpsters for the site shall be kept inside approved enclosures with doors shut.
  2. Used vehicle display and storage area shall be limited to the areas as shown on the site plan.
  3. All existing and new signage for the entire property shall be brought into conformance with current sign regulations as outlined in Section 12-4-101 of the Title XII Zoning Ordinance. Pole signs are prohibited within the Commercial Corridor Overlay, existing pole sign shall be removed. Approved sign permit and final site inspection is required prior to issuance of a Certificate of Occupancy.
  4. All signage and advertising from previous location at 1823 South Main Street shall be removed prior to issuance of a Certificate of Occupancy.
  5. Temporary signs, banners, and other advertisement shall not be allowed or permitted on the property.
  6. All buildings on the property shall be limited to the existing use of Auto Body/Collision Repair and the use associated with the conditional use permit request. Leasing or subleasing of other buildings is not permitted. If the uses are abandoned, all buildings on the property shall be subject to those uses as listed in Section 12-3-302 of the Title XII Zoning Ordinance.
  7. No variance shall be requested or granted for remodeling and operation of the business.
  8. Full compliance must be maintained and if a third violation notice is issued within an 18-month period all operations must cease until compliance is met.
  9. This conditional use permit will be void if the use is abandoned for more than 180 days.
 
 
 
 
3.g.
Consider approval of a final plat for Parker Meadows, 14 residential lots being 30.263 acres located at Zion Hill Loop, in the extraterritorial jurisdiction of the City of Weatherford, Parker County, Texas. SBD2022-0054.

Suggested Action:

Staff recommends approval of the final plat for Parker Meadows, subject to all requirements of the subdivision ordinance and, specifically, the following conditions:

 

1. Provide a signed letter from the Weatherford Post Office stating they accept the location and placement of cluster box units (Reference Weatherford Municipal Code (WMC) §11-5-3(e)).

2. Public improvements are required to be accepted before the final plat is recorded (Reference Weatherford Municipal Code (WMC) §11-5-9(c)(1)). A surety as required by Parker County will be required to record the plat prior to acceptance of public improvements (Reference Weatherford Municipal Code (WMC) §11-5-9(c)(2)). Provide documentation from Parker County that the letter of credit submitted is acceptable.

Consider approval of a final plat for Ranger's Place, two lots being 7.541 acres located at 1741 Ranger Highway, in the extraterritorial jurisdiction, City of Weatherford, Parker County, Texas. SBD2022-0055.

Suggested Action:

Staff recommends approval of the final plat for Ranger's Place, subject to all requirements of the subdivision ordinance and specifically the following conditions. 

 

1. A water main is required to be extended to and through the property. As a surety, a development agreement is required.

 
 
 
 
3.i.
Consider a request for final plat approval for the Wossum Ranch, Phase 4, 8 residential lots on 8.889 acres located east of Upper Denton Road, south of Trailwood Drive, City of Weatherford, Parker County, Texas. SBD2022-0050.

Suggested Action:

Staff recommends approval of the final plat for the Wossum Ranch Phase 4, subject to all requirements of the subdivision ordinance and, specifically, the following conditions:

 

  1. Preliminary Plat and existing conditions to the north lists the street as OakBend Trail. Why does it suddenly change in naming to Lone Oak Trail? Correct to be consistent with Preliminary Plat.
  2. Title Block requires to number of lots within the subdivision to be included. (Reference 11-5-2(1)(c))
  3. A note shall be included on the plat stating that all pre-existing easements and/or dedications have been vacated or incorporated into the creation of this plat. (Reference 11-5-2(m))
  4. Update Planning and Zoning Approval Block to be substantially similar to the the certificate as outlined in 11-5-2(q)(3). "This plat has been submitted to and considered by the Planning & Zoning Commission of the City of Weatherford, Texas, and is hereby approved by such Commission and passed to the City Council for its consideration and approval"
  5. Prior to recording of the final plat for each phase of the subdivision, the Developer Responsibilities as referenced in Section 1.A. of Subdivision Improvement Agreement, Amendment III shall be fulfilled.
  6. Provide dimensions for the proposed temporary turn around easement (Reference Weatherford Municipal Code (WMC) §11-5-2(m)). The temporary turn around easement will need to be created by separate instrument if it is outside the area to be platted. Include recording information for the easement (Reference Weatherford Municipal Code (WMC) §11-5-2(m)).
  7. Show the right-of-way centerlines for Oak Bend Trail and Twin Oak Trail (Reference Weatherford Municipal Code (WMC) §11-5-2(m)).
  8. Show the limits of the 100-year flood plain (Reference Weatherford Municipal Code (WMC) §11-5-2(o)). The drainage easement does not appear to be large enough to contain the limits shown in the drainage study.
  9. An approved preliminary plat is required before the final plat can be approved. (Reference Weatherford Municipal Code (WMC) §11-5-4(b)). Public improvements are required to be accepted before the final plat is recorded (Reference Weatherford Municipal Code (WMC) §11-5-9(c)(1)). A subdivision improvement agreement and surety are required to record the plat prior to acceptance of public improvements (Reference Weatherford Municipal Code (WMC) §11-5-9(c)(2)).
 
 
 
 
3.j.
Consider a request for final plat approval for University Hills, Phase IV, 42 residential lots on 14.61 acres located northeast of Ric Williamson Memorial Highway and Zion Hill Road, City of Weatherford, Parker County, Texas. SBD2022-0052.

Suggested Action:

Staff recommends approval of the final plat for University Hills, Phase IV subject to all requirements of the subdivision ordinance and, specifically, the following conditions:

 

  1. Remove zoning information (Note 12) and (Note 14) from the final plat (Reference Weatherford Municipal Code (WMC) §11-5-2). Zoning district information is subject to change and reviewed against the most currently adopted ordinance.
  2. Horizontal bearings shall be based on NAD 83, Texas North Central Zone 4202 (Reference Weatherford Municipal Code (WMC) §11-5-2(b)). Note 5 states it is based on Texas Central Zone 4203.
  3. Provide distances for roadway centerline segments (Reference Weatherford Municipal Code (WMC) §11-5-2(m)). Provide calculations showing at least 50 percent of the total street centerline length is curvilinear (Reference Weatherford Municipal Code (WMC) §11-6-3(d)).
  4. Include a note on the plat stating all pre-existing easements and/or dedications have been vacated or incorporated into the creation of this plat (Reference Weatherford Municipal Code (WMC) §11-5-2(m)).
  5. An approved preliminary plat is required before the final plat can be approved (Reference Weatherford Municipal Code (WMC) §11-5-4(b)). Public improvements are required to be accepted before the final plat is recorded (Reference Weatherford Municipal Code (WMC) §11-5-9(c)(1)). A subdivision improvement agreement and surety are required to record the plat prior to acceptance of public improvements (Reference Weatherford Municipal Code (WMC) §11-5-9(c)(2)).
  6. If Vanderbilt Drive is constructed before Dartmouth Drive is, a temporary turnaround bulb will be required at the east end of Vanderbilt Drive (EDCM) §2.1.23)
  7. The Vanderbilt Drive and Dartmouth Drive intersection should be tangent for at least 100’ (EDCM) §2.4.4). All other intersections are required to be tangent for at least 50’.
  8. Preliminary plat submittals show the segment of land west of Lots 25 and 26, Block 16 that is within the City limits as part of this property. Are the City limits and property boundaries shown correctly?
  9. Phase III final plat includes HOA Lot 13, Block, 16. Phase IV final plat includes the HOA area as Lot 12, Block 16.  Correct inconsistency.
